These Terms of Use (“Terms”) govern your access to and use of wildfire.group and any other Wildfire Local website, online assessment, report-request page, downloadable resource, or online feature that links to these Terms (collectively, the “Site”).

By accessing or using the Site, you agree to these Terms and the Wildfire Local Privacy Policy. If you do not agree, do not use the Site.

Wildfire Local (“Wildfire Local,” “Wildfire,” “we,” “us,” or “our”) is based in Overland Park, Kansas and provides visibility, website-readiness, local-search, business-profile, reputation, content, reporting, and related professional services to qualifying businesses.

1. WEBSITE TERMS ARE SEPARATE FROM CLIENT AGREEMENTS

The Site explains Wildfire’s business, methods, services, pricing direction, resources, and ways to contact us. Website content does not by itself create a client relationship, professional-services obligation, fiduciary relationship, partnership, agency relationship, or guarantee.

A client relationship begins only when Wildfire and the client accept approved written terms, which may include a proposal, order summary, operating terms, or statement of work. Those client-specific written terms control the scope, fees, billing, cancellation, ownership, service levels, and other terms of the engagement. If these website Terms conflict with approved client-specific written terms, the approved written terms control for that client engagement.

2. ELIGIBILITY AND BUSINESS USE

You must be at least 18 years old and legally able to agree to these Terms. The Site is intended primarily for business owners, business personnel, prospective clients, existing clients, and professional partners in the United States.

You may use the Site only for lawful business and informational purposes. You are responsible for the accuracy of information you submit and for ensuring that you have authority to submit information about a business, account, website, profile, employee, customer, or other person.

3. ACCEPTABLE USE

You may not:

  • Use the Site for an unlawful, fraudulent, deceptive, abusive, or harmful purpose.
  • Attempt to gain unauthorized access to the Site, a connected account, another user’s information, source code, prompts, systems, credentials, or nonpublic materials.
  • Interfere with, overload, probe, scan, scrape, reverse engineer, disrupt, or bypass security, rate limits, access controls, or technical restrictions.
  • Upload malware, harmful code, misleading information, infringing material, or content you are not authorized to use.
  • Use automated means to extract substantial portions of the Site or Wildfire’s reports, methods, frameworks, prompts, templates, or data without written permission.
  • Impersonate another person or business or misrepresent your affiliation, authority, or identity.
  • Use Site content to make unsupported claims of endorsement, certification, guaranteed ranking, guaranteed recommendation, or guaranteed business outcome.
  • Resell, sublicense, clone, or commercially exploit Site tools, reports, templates, or systems without written authorization.

Wildfire may restrict or block access when we reasonably believe use violates these Terms or threatens a person, system, client, or third party.

4. WEBSITE CONTENT AND INFORMATIONAL PURPOSE

We work to keep Site content accurate and useful, but search platforms, AI systems, laws, product capabilities, pricing, availability, and industry practices change. Site content may be incomplete, outdated, simplified, or subject to later verification.

The Site does not provide legal, tax, accounting, medical, financial, cybersecurity, regulatory, or other licensed professional advice. You should obtain advice from an appropriately qualified professional for those matters.

Do not make a material business decision solely from a general article, page, score, scan, automated output, or marketing statement on the Site.

5. ENLIGHTEN ASSESSMENTS, SCANS, REPORTS, AND RECOMMENDATIONS

Wildfire may offer assessments, scans, reports, scorecards, audits, previews, or related diagnostic services, including Wildfire Enlighten or a limited precursor to that product.

Unless a written agreement states otherwise:

  • A scan or report is based on information reasonably available at the time.
  • Findings may combine public data, submitted information, third-party reports, software output, and human analysis.
  • A score is a diagnostic or comparative tool, not a certification or guarantee.
  • A scan may not identify every defect, conflict, risk, platform issue, competitor action, or conversion problem.
  • Public and third-party data may be incomplete, delayed, inaccurate, personalized, or unavailable.
  • A recommendation may change after deeper access, verification, or discovery.
  • A report does not obligate Wildfire to perform remediation unless separately agreed.

You may use a report for your internal business evaluation. You may not alter a Wildfire report to misrepresent its source, remove material limitations, or falsely claim certification, endorsement, or guaranteed results.

6. AI-ASSISTED FEATURES AND AUTOMATION

The Site or Wildfire services may use AI-assisted tools, automated workflows, analytics, or software-generated summaries. Those systems can make mistakes, omit context, or produce unexpected results.

Do not treat an automated response as a final legal, financial, medical, tax, regulatory, or other professional determination. Do not submit passwords, private keys, API keys, Social Security numbers, full payment credentials, protected health information, or other highly sensitive information through a general website form, public-facing AI feature, chat, email, or text message.

Wildfire may use human review for material conclusions, but not every preliminary or automated interaction is reviewed in real time.

7. NO GUARANTEE OF RANKINGS, AI RECOMMENDATIONS, OR BUSINESS RESULTS

Search engines, maps, business-profile platforms, directories, review platforms, advertising systems, social networks, AI models, and other third-party systems control their own eligibility, indexing, rankings, citations, recommendations, features, policies, and outputs.

Wildfire does not guarantee:

  • Search rankings or map-pack placement.
  • Indexing or continued indexing.
  • Google Business Profile approval, reinstatement, feature access, or uninterrupted operation.
  • AI citations, mentions, recommendations, or answer inclusion.
  • Website traffic, calls, messages, appointments, leads, customers, conversion rates, revenue, profit, or return on investment.
  • Advertising approval, placement, cost, volume, or performance.
  • Continued availability of a platform, feature, integration, report, or measurement method.

Visibility, trust, citation, ranking, recommendation, and conversion are goals influenced by many factors outside Wildfire’s control.

8. PRICING, PROPOSALS, AND SERVICE AVAILABILITY

Prices shown on the Site are general starting points, typical ranges, examples, or current public offer information. They may change and may not apply to a particular business, location, website, market, scope, risk, platform condition, or client relationship.

An approved quote, proposal, order summary, or other client-specific written terms control the price and scope of a client engagement. Taxes, advertising spend, third-party charges, hosting, software, premium listings, paid verification, travel, custom development, and separately scoped work are not included unless expressly stated.

Submitting a form does not guarantee acceptance as a client. Wildfire may decline an engagement or recommend a different scope when the business, timing, risk, expectations, access, participation, or strategic fit does not support effective work.

9. FORMS, SUBMISSIONS, AND FEEDBACK

When you submit information through the Site, you represent that it is accurate, lawful, and submitted with appropriate authority.

You retain ownership of material you submit. You grant Wildfire a nonexclusive license to use, reproduce, analyze, store, and share the material as reasonably necessary to respond to your request, provide the requested service, protect our systems, comply with law, and maintain business records.

If you voluntarily provide feedback, suggestions, or ideas about the Site or Wildfire services, Wildfire may use them without restriction or compensation, provided we do not disclose your confidential information contrary to an applicable agreement.

10. EMAIL, TELEPHONE, AND TEXT COMMUNICATIONS

By submitting contact information, you authorize Wildfire to contact you about your request, assessment, appointment, proposal, client relationship, service, report, billing, or related business matter.

Marketing email may be stopped through an unsubscribe link or by contacting us. We may continue sending necessary transactional, service, security, billing, or relationship messages.

Marketing text messages will be sent only when an appropriate consent basis exists. Message frequency may vary. Message and data rates may apply. Where supported, reply STOP to opt out and HELP for help. Consent to marketing text messages is not a condition of purchasing a Wildfire service.

If a call is recorded or transcribed, notice or consent will be provided when required.

11. INTELLECTUAL PROPERTY

The Site and its original content, branding, graphics, design, copy, reports, scorecards, frameworks, templates, prompts, workflows, software, code, methods, documentation, and other materials are owned by or licensed to Wildfire and are protected by intellectual-property laws.

Wildfire grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for lawful personal or internal business evaluation. No ownership rights are transferred.

You may quote a reasonable excerpt with clear attribution and a link to the original page. You may not reproduce substantial portions, create a competing derivative product, remove proprietary notices, or use Wildfire intellectual property in a misleading way without written permission.

Wildfire Local, Visibility Reimagined, ENGAGE, Enlighten, Embrace, Evolve, associated logos, and other marks may be trademarks or service marks of Wildfire or their respective owners. No license to use a mark is granted except as necessary to identify Wildfire accurately.

12. THIRD-PARTY SERVICES, LINKS, AND EMBEDS

The Site may link to or use third-party websites, maps, videos, scheduling tools, payment processors, analytics, forms, communication tools, social platforms, directories, reports, or other services. Wildfire does not control their terms, privacy, accessibility, availability, accuracy, security, or content.

A link or integration does not necessarily imply endorsement. Your use of a third-party service is governed by that provider’s terms and policies.

13. PRIVACY

Our collection and use of personal information through the Site are described in the Wildfire Local Privacy Policy. By using the Site, you acknowledge that Policy.

14. ACCESSIBILITY

Wildfire is working to improve the accessibility and usability of the Site. Our current commitment, target, limitations, and feedback process are described in the Wildfire Local Accessibility Statement.

15. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL WEBSITE CONTENT, FREE RESOURCES, PRELIMINARY REPORTS, AND ONLINE FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WILDFIRE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDFIRE AND ITS OWNERS, PERSONNEL, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST REVENUE; LOST DATA; LOST RANKINGS; LOST PROFILE ACCESS; LOST BUSINESS OPPORTUNITY; OR THE COST OF SUBSTITUTE SERVICES ARISING FROM OR RELATED TO USE OF THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDFIRE’S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNT YOU PAID WILDFIRE SPECIFICALLY FOR ACCESS TO THE SITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

This limitation does not modify a liability provision in approved client-specific written terms. Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

17. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Wildfire and its owners, personnel, contractors, and service providers from third-party claims, liabilities, losses, and reasonable costs arising from your unlawful use of the Site, violation of these Terms, infringement of another person’s rights, or unauthorized submission of information or material.

18. SUSPENSION AND TERMINATION OF SITE ACCESS

Wildfire may suspend, restrict, or terminate access to the Site or a Site feature at any time when reasonably necessary for maintenance, security, legal compliance, misuse prevention, product changes, or protection of Wildfire or others.

Termination of Site access does not terminate or modify a separate client agreement, payment obligation, hosting relationship, or other contract unless that agreement expressly says so.

19. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law rules.

Any legal action arising solely from these website Terms must be brought in the state or federal courts located in Johnson County, Kansas, unless applicable law requires another forum. Before filing a formal action, the parties should attempt in good faith to resolve the issue through direct discussion.

20. CHANGES TO THE SITE OR THESE TERMS

Wildfire may update the Site, discontinue a feature, or revise these Terms. The revised Terms will be posted with a new “Last updated” date. Your continued use after a revision becomes effective constitutes acceptance of the revised Terms, to the extent permitted by law.

21. GENERAL PROVISIONS

If a provision is held unenforceable, the remaining provisions remain effective, and the unenforceable provision will be modified only to the minimum extent necessary.

Failure to enforce a provision is not a waiver. These Terms do not create third-party beneficiary rights. Headings are for convenience only.
